CONTRACT
The following contract is entered into between Galapagos Go Active and the Client, who is the person traveling on a tour operated by the company Galapagos Go Active . The Client(s) are subject to having read and understood our travel policy as stated below. By making a reservation by telephone, or through the website, or by email or any means of communication, you agree to and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the Client in relation to the subject matter hereof, and shall constitute a binding agreement. There is no verbal or written representation, warranty, guarantee agreement, prior agreement, description of services, or conditions or any promise of refund other than those expressed herein. The service to be provided is/are the tour(s) mentioned in the booking confirmation.
RESERVATION
At the time of making and guaranteeing the reservation, Galapagos Go Active requires a completed reservation form (either the one on our website or the one sent by us with your quote) or to have shared reservation messages between the Galapagos Go Active agent and the client indicating the client’s full confirmation, along with the payment of the necessary deposit according to the reservation policy. The appropriate time to make your reservation is 30 days before your trip to Ecuador and it is possible to book with more time in advance, a reservation is accepted and becomes definitive only from the date on which your deposit was made and at that time there is a contract. Galapagos Go Active reserves the right to reject any reservation at its discretion, in extreme cases due to transfer or deposit problems, the client must make his reservation without the deposit and be subject to a reservation with a time limit indicated by the Galapagos Go Active Agent, the company is not responsible for the reservation outside the indicated date and take into account the time limit.
CUSTOMER
In order to confirm and guarantee the Clients the organization of the trip the Client must provide all his identity details with the initial payment or no later than 30 days before the start of the trip. Client details include passport number, copy of passport details and medical form (if applicable), full name, date of birth, international flight information and nationality, case phone or mobile for any emergency.
PAYMENT/ SURCHARGES
In order for our company Galapagos Go Active to confirm and guarantee to the Clients the organization of their trip; the client must provide all the client data with their final payment at the beginning of the Tour.
Surcharges: To avoid surcharges on your vacation, make your reservation in advance, do not change hotels/reservations at the last minute, changing hotels or reservations may affect your reservation with Galapagos Go Active .
CHANGE OF RESERVATIONS
An administration fee of US$80 per person will be charged if the confirmed reservation is changed or transferred to a different departure date or tour, up to 30 days prior to your trip. Thereafter all changes will be treated as cancellations and subject to charges as follows. Please ask for availability for a date change to the one booked with Galapagos Go Active and the company is not responsible for any inconvenience caused by the client’s date changes.
If a client is not in a position to travel, and tells us about 20 days in advance, in circumstances that Galapagos Go Active considers reasonable, then the reservation may be transferred to another suitable person, or your money will be returned less 20% since 10% goes to money transfer payments and the other 10% are administrative costs, your money will be returned in less than 30 days.
CHANGES
Galapagos Go Active reserves the right to modify any of the facilities, services or prices described in the brochure/website or emails listed with prices/or quoted with a sales agent. If such a change is made, the client will be informed at the time of booking or when the change occurs. While the company will endeavour to operate all tours as advertised, reasonable changes to the itinerary may be made when deemed necessary or convenient by the Company due to external factors beyond the control of the company.
CANCELLATION OF Galapagos Go Active
Galapagos Go Active reserves the right to cancel any trip before execution is guaranteed, but will not cancel the trip less than 30 days before departure.
Your trip is guaranteed to operate unless otherwise indicated by the minimum number or by factors beyond the control of Galapagos Go Active . This applies to departures within the range of validity of the brochure or proposed programs.
COMPLAINTS
If the client has a complaint about any of the tour arrangements, it is a condition of the contract that they tell our local representative at that time. If they do not complain at that time, we are subsequently denied the opportunity to investigate and rectify the problem and so do Galapagos Go Active cannot accept any liability. If the client has a dispute with Galapagos Go Active and cannot resolve it, please write to us within 28 days of your return and we will investigate further to properly handle and resolve the problem.
Any disputes or problems arising from non-compliance by either party will be resolved with the person responsible for the trip or the highest authority of the company.
TRAVEL AND INSURANCE POLICY
Travel insurance is highly recommended for all clients who book a tour and we recommend that it should cover personal injury, medical expenses, repatriation costs, evacuation costs, cancellation and curtailment. It is our policy to check the validity and coverage of your insurance policy and we reserve the right to refuse carriage to anyone whose insurance does not meet these criteria.
RESTRICTIONS
We are interested in you enjoying your stay in Ecuador, for which we need to know your dietary restrictions and your health behavior, allergies, vegetarians, vegans, vertigo, phobias, asthma and others that can be harmful to your health if not properly controlled and must be warned in the reservation.
FINANCIAL SECURITY
Galapagos Go Active L is a travel agency accredited by the Ministry of Tourism and registered as a limited company and controlled by the Superintendency of Companies. Galapagos Go Active complies with current European regulations regarding the protection of customer money.
CUSTOMER RESPONSIBILITY
The client agrees to accept the authority and decisions of Galapagos Go Active , tour leaders and agents while on vacation. If in the opinion of these persons, the health or conduct of a client at any time, before or after departure appears to endanger the progress of the tour, safety, comfort or tranquility, the client may be excluded from all or part of the tour.
Customers must be in possession of their respective identification documents, and are responsible for carrying a valid passport with a visa, if applicable, and the vaccination certificates required for the entire trip.
Galapagos Go Active Bookings are accepted on the understanding that they appreciate the potential risks inherent in adventure travel and that any visits, excursions or expeditions, as listed in our programs, are undertaken at their own discretion. It is also important to understand that the most meticulous arrangements can go wrong.
The company is committed to providing its services with the necessary diligence, so that the entire trip goes perfectly, we will strive to serve you in the best possible way.
Galapagos Go Active assumes no responsibility for force majeure, weather phenomena or natural phenomena that may occur before or during the trip, or for any eventuality that may make any trip uncomfortable or difficult, or for any delay or obstruction of your trip in any way and does not guarantee the failure on the part of the Company, whether for the total or partial execution of the provision of the services that the Company has undertaken to provide which may have been affected by the aforementioned factors.
FLIGHTS / DELAYS
We cannot accept any responsibility for cancellations or delays in any of your planned flights within Ecuadorian territory, if the cancellation or delay is due to adverse weather conditions, airline rescheduling, airport authority and/or air traffic controllers’ action, or problems beyond our company’s control.
Our company will do its best to arrange your travel itinerary so that all inconveniences are resolved and nothing is affected by flight delays.
CHILDREN’S POLICY
For all programs, unless otherwise stated, the maximum age for a child is 11 years and 11 months. Children over 12 years of age are considered adults and will be subject to adult rates.
Rates for children under 11 years of age change, for which you must quote with the responsible agent of Galapagos Go Active and the reservation will be made based on the quote.
LAST MINUTE RESERVATIONS
For all bookings made within 10 days of departure, there will be a USD $50.00 fee charged on file. This Last Minute fee covers our additional costs for Hotel, Train Ticket, Bus Ticket suppliers and operational expenses.
I hereby declare that I have read and understood the Terms and Conditions stated above, in addition to the conditions of sale as stated by the company on the website/brochure or form provided and that I am fully aware that my signature confirms this declaration.
LAST MINUTE PRICE
Last Minute reservations must be paid directly to our staff in full or deposited into our bank account before the trip or tour. Last Minute is a current price and may vary depending on the dates or your needs. Galapagos Go Active is not responsible for sudden price changes. If the company offers an affordable rate that meets your needs, you can book instantly; don’t leave it for tomorrow because it may vary.

Galapagos Go Active promotes its tourism products on different advertising channels, Facebook, Google, website, Tripadvisor and national and international tourist guides. If you contact us through any of our advertising channels, we will consider the current rates of the page or medium from which you contact us.
Our advertising media is updated every year, except for last minute prices or promotions.
